These Terms and Conditions ("Terms") govern your access to and use of the BOHFY website (www.bohfy.com), products, software, and services (collectively, the “Services”) provided by Bit Barfi Technologies Pvt Ltd (“BOHFY”, “we”, “us”, or “our”).

By using our Services, you agree to comply with and be bound by these Terms. If you do not agree, please refrain from using our platform.

1. Eligibility

You must be at least 18 years old and legally competent to enter into a binding agreement to access and use our Services.

2. Account Registration

To access certain features, you are required to register and create an account. You agree to:

• Maintain the confidentiality of your credentials

• Take full responsibility for all activity under your account

We reserve the right to suspend or terminate accounts in violation of these Terms.

BOHFY provides cloud-based SaaS solutions tailored for the food and hospitality sector, including:

• Digital menu management

• Billing and order management

• Inventory tracking

• Reporting and analytics tools

4. Subscription & Payments

• Services are provided on a subscription basis. Pricing details are available on our website.

• All payments must be made in advance through approved methods.

• Subscriptions auto-renew unless cancelled before the renewal date.

• You may cancel your subscription anytime; however, no refunds are provided for partial months or unused features unless covered under our refund policy (see Clause 5).

5. Refund Policy

BOHFY offers a 7-day satisfaction guarantee from the date of first subscription activation. If you're not satisfied, contact us within this period for a full refund.

Refunds will not be issued under the following circumstances:

• Requests made after 7 days from activation

• Renewal charges

• Temporary service outages or interruptions

6. Service Uptime & Commitments

BOHFY aims to maintain 99.5% uptime for all hosted services. We conduct regular maintenance and will notify users in advance for planned downtimes.

We are not responsible for service interruptions caused by:

• Internet connectivity issues on your end

• Acts of God, third-party outages, or force majeure events

7. User Conduct

You agree not to:

• Use the Services for unlawful activities

• Modify, reverse-engineer, or exploit our software

• Upload viruses or any malicious code

• Share your login credentials with unauthorized parties

Violation of these terms may result in termination of your access without prior notice.

8. Intellectual Property

All content, software, and trademarks on BOHFY are owned by or licensed to us. You may not use our branding or replicate our technology without written permission.

9. Data Privacy & Security

We respect your privacy and comply with applicable data protection laws. By using BOHFY, you consent to our Privacy Policy which outlines:

• What data we collect

• How we use and protect it

• Your rights regarding your personal data

We implement encryption, access controls, and regular audits to safeguard your data.

10. Third-Party Integrations

Our platform may integrate with third-party tools (e.g., payment gateways, analytics platforms). BOHFY is not liable for any issues arising from those services.

11. Limitation of Liability

To the maximum extent permitted by law, BOHFY is not liable for:

• Indirect or incidental damages

• Data loss or business disruption

• Customer losses due to reliance on inaccurate reporting or integrations

Our total liability will not exceed the amount you paid in the six (6) months prior to the claim.

12. Termination

We may suspend or terminate access to our Services if you:

• Breach these Terms

• Engage in misuse or illegal activity

• Fail to make timely payments

You may cancel your account at any time by contacting us.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted here with the revised date. Your continued use of the Services constitutes acceptance of those changes.

14. Governing Law

These Terms are governed by the laws of India, and any disputes shall be subject to the jurisdiction of Pune, Maharashtra.
